Chicago Immigration Attorney for Outstanding Researchers

Illinois Immigration Lawyer for Outstanding Professors

Outstanding professors and researchers may be able to obtain permanent residency pursuant to an EB 1-2 visa and avoid the labor certification process.  In order to be eligible for an EB 1-2 visa, the professor or researcher must have three years of research or teaching experience and must demonstrate that he or she is internationally recognized as “outstanding” in a particular academic field.

The Chicago immigration law firm of Badia-Tavas Law Group, Ltd. has considerable experience helping foreign nationals, including outstanding professors and researchers, to satisfy their visa and immigration needs so that they may enter the United States and pursue their course of teaching or research.  Whether through an EB 1-2 visa, an H1-visa for the education industry, an O visa, or another visa type, we can advise you of your immigration options and assist you with the application process.

Eligibility Requirements

In order to be eligible for the EB -1-2 visa, the applicant must be an “outstanding” professor or researcher who has at least three years of experience in teaching or research in a particular academic area. The applicant must be entering the United States in order to pursue a long-term employment situation in a tenured or tenure-track teaching or a comparable research position at a university or other institution of higher education.  For private sector employers, the requirements are slightly different.

“Outstanding” In a Particular Field

To demonstrate being “outstanding,” an applicant must demonstrate meeting at least two of the following six specific factors:

•    Receipt of major prizes or awards for outstanding achievement in a particular academic field
•    Membership in associations in the academic field which require outstanding achievements of their members
•    Published material in professional publications written by others about the applicant’s work in a particular academic field
•    Participation, either individually or on a panel, as the judge of the work of others in the same or affiliated academic field
•    Original scientific or scholarly research contributions to the academic field
•    Authorship of scholarly books or articles in scholarly journals with international circulation in the academic field
