What is the H-2B Visa?

The H-2B visa is a nonimmigrant work visa available for foreign nationals who enter the United States temporarily to engage in seasonal or sporadic nonagricultural employment.  In order to be eligible for the H-2B visa, the employer must show that the foreign national is needed for employment that is one of the following:

•    Seasonal – employee is hired to perform services that is traditionally tied to a season of the year and is of a recurring nature
•    Intermittent – employer has not employed permanent or full-time workers to perform certain services, but it occasionally needs temporary workers to perform such services for short periods of time
•    Peak load need -  employer needs to supplement its permanent workforce on a temporary basis due to a seasonal or short term demand with temporary employees that will not become a part of the employer’s permanent staff
•    One-time occurrence – employer has not employed employees to perform the services in the past and will not need the employees to perform the services in the future
